The mandatory ten-year insurance does not cover any water leak due to the mere fact of occurring in the first ten years of the building.

A leak could be linked to the ten-year insurance if it results from a covered structural defect and compromises the mechanical resistance or stability of the building. In contrast, if it is a problem with waterproofing, roofing, facade, sealing, finishes, maintenance, or livability, it may require a separate additional warranty.

Therefore, before claiming that a leak is covered, it is necessary to check:

Technical origin of the filtration.

If it affects structural elements.

It compromises stability or mechanical resistance.

If there is a three-year warranty, contracted waterproofing or sealing.

If the damage results from a lack of maintenance.

If it occurred within the applicable coverage period.

One-year warranty, three-year warranty and annual warranty

The Building Regulation Act distinguishes several deadlines for liability for rialmaterial damage in construction. This does not mean that it is irrelevant.

In hotels, residences, offices, shopping centers, warehouses, rialindustrial buildings, or projects for tertiary use, it may be advisable to contract structural damage guarantees, all risks construction, civil liability, a deposit, or other technical insurance if required by the contract, the financier, the buyer, the investor, or the risk management policy itself.

The General Directorate of Legal Security and Public Faith has recalled in recent resolutions that the requirement for ten-year insurance is linked to the main purpose of the dwelling, and has distinguished certain residential or lodging uses that do not necessarily have the character of housing for these purposes.

Is it possible to register a deed without ten-year insurance?

In cases where the ten-year insurance is mandatory, public deeds of declaration of new construction will not be authorized or registered in the Property Registry unless the establishment of the required guarantees is proven.

In practice, this can block or complicate:

Declaration of new construction.

Registration in the register.

Sale of new construction homes.

Mortgage financing.

Transmission within ten years in certain cases of self-promotion.

If it is an individual self-promoter of a single single-family home for personal use, an initial exemption may exist. However, if a “inter vivos” transfer occurs within ten years, the self-promoter may be obliged to take out the guarantee for the remaining time, unless there is a contrary agreement and express exemption by the buyer in accordance with the terms provided for by law.

Who has to take out the ten-year insurance?

In the ten-year warranty, the guarantor is usually the developer. The Building Regulation Act allows the developer to explicitly agree with the builder that the latter will be the guarantor of the insurance on behalf of the developer, but the obligation must be properly covered.

The insured are the promoter himself and the successive purchasers of the building or part of it. This is an important difference compared to other construction insurance: the decennial policy is designed to protect those who purchase the home during the warranty period as well.

Before hiring, it is advisable to identify the following:

Promoter.

Constructor.

Policyholder.

Insured.

Building or registered units insured.

Final cost of execution material.

Date of receipt of the work.

When does the ten-year warranty start and end?

The ten-year period begins upon receipt of the work, without reservations, or upon rectification of any defects if there were any. Receipt is the act by which the builder delivers the finished work to the developer, who accepts it.

Therefore, to correctly calculate the validity of the ten-year insurance, it is not enough to look at the date of construction commencement or the date of license. The receipt of the work, the final certificate of completion, and, if any reservations existed, the documentation of rectification must be reviewed.

Ten-year insurance without OCT

The OCT, or Technical Control Office, should not be understood as an independent legal guarantee, but as a very relevant technical figure in insurance practice. Many insurers require it to analyze and accept the risk, especially in new residential construction.

The OCT reviews technical aspects of the project and its execution to issue reports that help the insurer assess the quality of the work and the structural risk. Without this oversight, contracting a ten-year insurance policy can be more difficult, more expensive, or require additional technical reports.

In completed works without OCT, solutions may exist, but they often require more intensive technical review. It depends on the type of construction, the use of the building, the cost of executionrial, location, structural system, the promoter's experience, the existence of OCTs, additional guarantees, and the level of technical risk.

The factors that usually have the greatest influence are:

Final cost of execution material: The legal reference for the insured capital is linked to rial the final cost of execution itself, including professional fees.

Use of the building: It is not the same to have a multifamily housing project than a single-family home, a rehabilitation project, a hotel, a mixed-use building, or a tertiary use building.

Structural complexity: Special construction systems, complex foundations or risky terrains can increase the cost of contracting.

Existence of OCT: Technical supervision can facilitate the acceptance of risk.

Recruitment moment: It is not the same to insure a work from the beginning as to seek a ten-year insurance for a work that has already been completed.

Additional guarantees: Waterproofing, impermeability, three-year warranty, damage to pre-existing structures, or renunciations to recourse may alter the cost.

Instead of publishing closed prices, the most prudent thing to do is to request a quote with actual technical documentation. Two projects with similar budgets can have different premiums if the terrain, structure, use, or technical historyrial of the project change.

Do you need to take out a ten-year insurance policy?

At PIB Group Iberia we review the type of work, the use of the building, technical documentation, OCT, insured capital, mandatory guarantees and additional coverages to help you find a suitable solution.
Requests a personalized assessment.

One-year guarantee for completed work

It is possible to take out a ten-year insurance for a completed project, but it is usually more complex than doing so from the start of the project. The insurer has not been able to keep up with the progress of the project and therefore needs to technically reconstruct the risk through documentation and reports.

In these cases you can ask for:

Project and final documentation of the work.

Final certificate of work.

Receipt document.

Building manual.

Technical or structural reports.

Additional tests or examinations.

On-site inspection of the property.

Historyrial of incidents, repairs or reservations.

If OCT did not exist during execution, the underwriting may require more documentation and not all insurers will accept the risk under the same conditions.

Auto-promoter and ten-year insurance

The individual promoter who builds a single single-family home for their own use may be exempt from contracting the ten-year insurance at the initial stage. This exception should not be interpreted broadly for any particular development.

To apply this exception, several elements must be reviewed:

That it is an individual self-promoter.

That it be a single single-family home.

That it be for personal use.

That such use can be proven if it is subsequently transmitted.

That there is no promotion for sale to third parties.

If the property is transferred before the ten-year period has expired, it may be necessary to contract for the remaining term, unless the buyer expressly exempts the seller from liability under the terms provided by law.

One-year insurance for renovations and repairs

In renovations, extensions or reforms, the obligation must be examined more carefully. The Building Regulation Act can apply to interventions on existing buildings when they alter their architectural configuration, produce a fundamental variation in the exterior composition, volume or structural system, or change the typical uses of the building.

Therefore, not every renovation requires a ten-year guarantee. However, a thorough renovation, structural expansion, or a significant change in use may require technical and legal analysis before writing a deed, selling the property, or financing the transaction.

Difference between ten-year insurance and comprehensive construction insurance

The ten-year insurance and the comprehensive construction insurance respond to different times and risks.

Insurance

When it acts

What it protects

All construction risks

During the execution of the work.

Accidental damage to the work, equipment, rialmaterials, or other risks contracted during construction.

Civil liability in construction

During the construction and, according to the policy, in certain subsequent periods.

Damage to third parties resulting from the activity of the promoter, builder or intervening agents.

One-year guarantee

After receiving the work.

Structural damage covered for ten years.

On mobile, slide the table horizontally to see all the information.

What happens if the ten-year insurance is not purchased when it is mandatory?

Not contracting the ten-year insurance when it is mandatory can have relevant consequences. The Building Regulation Act establishes that failure to comply with the rules regarding mandatory underwriting guarantees entails the obligation to personally respond to the person obligated to sign them.

Furthermore, in cases where the guarantee is enforceable, the declaration of new construction will not be authorized or registered without proof of the establishment of the corresponding guarantees.

In practice, this can affect the commercial and financial viability of the promotion:

Difficulty in registering the new work.

Problems selling the homes.

Risk of registry blockage.

Problems obtaining mortgage financing.

Personal responsibility of the person obliged to contract the guarantee.

Conflicts with buyers, financiers or third-party acquirers.

How to contract a ten-year insurance plan step by step?

Procurement must be planned from the very early stages of the project.
