Today we will talk about what we do and what companies do when they work without an intermediary, directly with the client.<\/p>\n<h2>The Insurance Contract Law is clear<\/h2>\n<p>In the<strong> Law 50\/1980<\/strong> regulates everything related to insurance policies, the obligations of the companies and the rights of the customer. Article 22 deals with the <strong>time limits for cancelling a policy<\/strong>, by both the customer and the company (and which changed in 2016, shortening the deadline for customer communication).<\/p>\n<p>Art. 22.2 Law 50\/1980:<\/p>\n<p style=\"text-align: center;\"><em>\u201cThe parties may oppose the extension of the contract by giving written notice to the other party at least one month before the end of the current insurance period when the party opposing the extension is the policyholder, and two months when it is the insurer\u201d.\u201d<\/em><\/p>\n<p>In this article from a few months ago, we talked about <a href=\"\/en\/blog\/how-to-cancel-an-insurance-policy\/\">how to cancel an insurance policy <\/a>by a client: what means to use for record keeping, deadlines, etc.<\/p>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter wp-image-4755\" src=\"\/wp-content\/uploads\/2017\/06\/anulacion-seguro.jpg\" alt=\"Insurance company and cancellation\" width=\"949\" height=\"632\" \/><\/p>\n<h2>How some insurance companies deal with their customers<\/h2>\n<p>For some years now, we have found that <strong>some insurer does not respect the law<\/strong> on the point we were looking at earlier. That two-month deadline, which must be absolutely clear, without room for doubt, is not met in many cases.<\/p>\n<p><strong>The causes?<\/strong> They could be:<\/p>\n<ul>\n<li>A claim that the client may have had in the last year.<\/li>\n<li>A reconsideration of the company's risk policy, leading to cancellation of portfolio policies for X reasons.<\/li>\n<li>...<\/li>\n<\/ul>\n<p>The problem is not that the company wants to cancel a policy (although sometimes they do it too easily); it is that they do not respect the legal deadlines for warning the policyholder. Too often, they do so only a few days in advance or not at all, and the policyholder is not informed at all. <strong>the customer has 2 alternatives<\/strong>:<\/p>\n<ol>\n<li>That, due to ignorance of the law, he must seek insurance within a few days to replace that policy.<\/li>\n<li>That, since he does not know that he does not have insurance, he drives his car without a policy or does not have insurance on his home, etc. etc. etc. An enormous risk.<\/li>\n<\/ol>\n<h2>The after-sales service of an Insurance Brokerage Firm<\/h2>\n<p>All those clients who have a mediator, or at least our policyholders, enjoy a very clear protocol when a company notifies us of the \u201cwrite-off\u201d (as they call it) or cancellation of a policy:<\/p>\n<ol>\n<li>We spoke to the company to try to <strong>fight against the cancellation of this insurance<\/strong>\u00a0(provided that economic conditions keep them close to the previous year's price).<\/li>\n<li>We notify the client, if we have not succeeded in retaining the policy, and <strong>we inform you of competitive alternatives<\/strong>, to replace the insurance that is cancelled by the insurer.<\/li>\n<\/ol>\n<p>We always say it: having an Insurance Brokerage looking after your interests is not silly. We would love for our clients to be able to see how we work and how we can help them. <strong>we talk to the companies fighting for the interests of our policyholders<\/strong> (in the event of a claim, renewal, etc.).
