We are constantly asked by clients and friends if having a vehicle in their name, even if it is parked in a garage 365 days a year, for whatever reason, means having to take out insurance. The answer is already a YES, but we are going to explain why and on the basis of which regulations this is the case.<\/p>\n

There is no doubt in the law<\/h2>\n

Owning a motor vehicle in Spain, involves the obligation to take out a policy<\/strong>, the only strictly necessary guarantee being that of Civil Liability<\/strong>.<\/p>\n

This means that the aim of the legislation is to cover the damage that our car, motorbike, quad, etc. may cause to third parties.<\/p>\n

This is set out in Royal Legislative Decree 8\/2004, of 29 October, and its \u00abTexto refundido de la Ley sobre responsabilidad civil y seguros en la circulaci\u00f3n de veh\u00edculos a motor\u00bb (Revised text of the Law on civil liability and insurance in the circulation of motor vehicles).\u00bb<\/em><\/p>\n

If it is stationary, what damage can it cause?<\/h2>\n

Many customers have vehicles that they hardly use.<\/p>\n

It makes no difference whether you are driving or not, as the law is clear and will require car insurance. Precisely for this reason, the only guarantee required is Civil Liability, to cover the damage that our vehicle may cause to others: people, property, etc.<\/p>\n

What are the consequences if I don't have insurance?<\/h2>\n

These are set out in the legislation that regulates these matters, as we have already mentioned, which is Royal Legislative Decree 8\/2004:<\/p>\n

  1. The first, the most logical one, is that if they detect that we do not have this policy, they will the car would be immobilised.<\/strong> I don't think we'll mind too much if we don't plan to move it....<\/li>\n
  2. The others, however, are more painful for us:\n

    1. They would impose a penalty of 601 to 3,005 euros<\/strong>, depending on the seriousness of the offence (whether or not you were driving, how long you had been without a policy, etc.).<\/li>\n
    2. Also the vehicle shall be left in storage<\/strong> until insurance is taken out, and the bill will be at the owner's expense.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n

      Trailers and special vehicles under 750 kg do not need a policy, unlike what we are talking about.<\/p>\n

      Finally, in order to specify the only exception<\/strong> to all of the above: it will not be necessary to take out this policy if the vehicle has been given to us by us. of deregistration in the Register of the Directorate General of Traffic<\/strong>. This is the only exemption. To do this, be careful, we must have passed the ITV<\/strong>, It will therefore be necessary to have insurance to take it for inspection. It is possible to take out daily insurance for this.<\/p>\n
