Does life insurance cover a workers' compensation claim for disability?

Table of contents

The Life insurance does not automatically cover a work-related injury. It is common for life insurance to cover death and, if specifically contracted, certain situations of permanent disability. In contrast, temporary work-related disability usually requires a different type of policy: a sick leave insurance, a temporary disability insurance, a subsidy insurance or a daily compensation guarantee.

Confusion is common because similar terms are used: short-term disability, temporary disability, permanent disability, invalidity, total disability, absolute disability or life insurance with disability coverage. But not all of them mean the same thing and not all of them are covered by the same policy.

At PIB Group Iberia we can help you check if you need one. sick leave insurance, a life insurance, a accident insurance or a combination of coverages to protect your income if you can't work.

Quick answer: Does life insurance cover a work-related injury?

  • Not by default: A standard life insurance policy usually does not pay for temporary unemployment benefits.
  • Yes, it can cover permanent disability: If the policy includes disability, permanent total, partial, or occupational disability.
  • For a temporary reduction: It is usually necessary to have workers' compensation insurance, temporary disability, or a daily allowance.
  • For self-employed individuals: It can be especially useful to supplement the public provision with private daily compensation.
  • For employees: It can also make sense if the reduction reduces income, benefits, variable payments, or debt-paying capacity.

What is a disability leave?

An incapacity for work benefit is granted when a person is temporarily unable to work due to illness, accident or a protected situation. From the Social Security point of view, it is usual to speak of temporary incapacity when there is a temporary inability to work and healthcare is received.

The General Law on Social Security considers temporary disability, among other circumstances, situations resulting from common or occupational illness and accident, whether work-related or not, while the worker receives healthcare and is unable to work, with a maximum total duration of 365 days extendable by another 180 days if it is presumed that they can be discharged after recovery.

You can consult the Restructured text of the General Law on Social Security and the official information from the Social Security regarding temporary disability.

Temporary disability and permanent disability: differences

The first important distinction is separating a temporary disability from a permanent disability. They are not covered equally, processed equally, and do not trigger the same insurance benefits.

Situation What it means I'm sure it can fit
Temporary disability Temporary medical leave due to illness or accident, with the expectation of recovery. Unemployment insurance, daily allowance, temporary disability, or daily compensation.
Partial permanent disability It reduces work performance, but does not prevent the fundamental tasks of the profession. Accident insurance or specific guarantee, if contracted.
Total permanent disability It prevents you from practicing your usual profession, but allows you to work in another profession. Life insurance with professional or total disability, if it is included.
Absolute permanent incapacity It prevents you from pursuing any profession or trade. Life insurance with permanent total disability.
Great inability In addition to being unable to work, they require help from another person for essential tasks. Life insurance or accident insurance with specific coverage, if provided for.

How much is paid for a work-related injury?

The public benefit depends on the reason for the reduction, the regulatory basis, and the worker's employment status. As a general reference, in common illness or non-work-related accident, 60% of the regulatory basis is paid from the fourth day of the reduction until the 20th inclusive, and 75% from the 21st onwards.

In the case of an occupational accident or occupational disease, the benefit is 75% of the regulatory base from the day following the leave. In the case of workers employed by third parties, the payment is usually made through a payment delegated by the company; in the case of self-employed individuals, the payment is made directly by the managing entity or the competent mutual fund.

Origin of the decline Guidance public service What could be missing
Common disease 60% from the regulatory base on day 4 to day 20; 75% from day 21. Variable income, self-employed with a low base, fees, rent, loans, and family expenses.

Work-related accident 75% of the regulatory base from the day following the cut. Uncovered fixed costs, debts, self-employed individuals and loss of activity.

Life insurance and unemployment benefits: what they really cover

Life insurance is primarily used to financially protect beneficiaries in the event of the insured’s death. It can also include additional guarantees of permanent disability, such as absolute, total, or occupational disability, as specified in the policy.

The Insurance Contract Act establishes that, with life insurance, the insurer is obligated, within the limits of the law and the contract, to pay the beneficiary a capital, income, or other benefits agreed upon in the event of death, survival, or both events. Therefore, to determine whether it covers disability, it is necessary to read what guarantees have been contracted.

You can check the Law 50/1980 on the Insurance Contract.

In practice, if your unemployment benefit is temporary, the life insurance will only help you if it includes a specific guarantee that covers temporary disability, allowance, payment protection, or advance payment under certain circumstances. If that guarantee does not exist, it should not be assumed that you will be paid.

How does the workers’ compensation insurance work?

A sick leave insurance It is designed to supplement income when you are temporarily unable to work due to illness or accident. You can pay a daily or monthly amount during the covered period, within the limits of the policy.

There are different ways of operation:

  • Daily compensation for absence: A sum is paid for each day of approved leave, according to the conditions.
  • I am concerned about pathology: The insurer pays a set number of days depending on the diagnosis or intervention.
  • Hospitalization: A fee is paid if hospitalization is covered.
  • Payment protection: Specific loan, mortgage or other commitments are covered.
  • Combination of guarantees: Some policies combine low-cost coverage for hospitalization, accident, and disability.

The most important thing is to check whether it covers common illness, non-occupational accident, occupational accident, occupational illness, and relapses.

Sick leave insurance for the self-employed

Self-employed individuals often face more economic exposure in the event of a downturn. Although they may access public benefits for temporary disability if they meet the requirements and have the corresponding coverage, their professional and personal expenses can remain: self-employed fee, rent of premises, employees, supplies, loans, mortgages or suppliers.

Therefore, a workers' compensation insurance for self-employed individuals can help fill the gap between public benefits and actual expenses.

It can be especially useful for:

  • Self-employed individuals with income directly linked to their presence or daily activity.
  • Healthcare professionals, legal professionals, technical, commercial or creative professionals.
  • Transport workers, installers, manual trades or activities with a physical risk.
  • Businesses with local employees or relevant fixed costs.
  • Self-employed people with mortgages, families or personal debts.

You can find more information in our guide on Sick pay insurance for the self-employed.

Unemployment insurance for salaried workers

A self-employed worker can also assess an unemployment insurance claim, especially if part of their income depends on commissions, incentives, shifts, bonuses, overtime hours, or variables that are reduced during the period of unemployment.

It may also make sense if there are relevant payment commitments:

  • Mortgage.
  • Personal loans.
  • Shares in a corporate entity or a secondary activity.
  • High family expenses.
  • People economically dependent.
  • Treatments or expenses not covered by the public system.

Before hiring, it is advisable to check whether the collective agreement improves public benefits and for how long. If the agreement already supplements up to 100% during the entire leave, the private need may be less; if there is no supplement or it is limited in time, the insurance may make more sense.

Accident and disability insurance

Accident insurance can cover injuries resulting from a violent, sudden, external cause unrelated to the insured party’s intent that result in temporary or permanent disability or death, subject to the terms of the contract.

This means that accident insurance can be useful, but it does not always cover all work-related injuries. It may only cover accidents and exclude common illnesses. Therefore, if you want to cover both illness and accident, you should check that the policy explicitly includes this.

Before you sign up for accident insurance, check:

  • If it covers only accident or also illness.
  • Capital for permanent disability.
  • Temporary compensation for days of absence from work.
  • Professional activities excluded.
  • Sports or risky activities.
  • Disability certificate.
  • Franchises, shortcomings, and limitations.

Payment protection insurance if you can't work

If your main concern is paying a mortgage, loan or debt in the event of a drop in income, you may be interested in reviewing a payment protection insurance policy. This type of policy does not always pay you a free rent, but can cover specific installments for a period of time and under certain circumstances.

You should check:

  • What coverage does it cover.
  • Maximum monthly amount.
  • Maximum number of monthly installments.
  • If it covers temporary disability, unemployment, or both.
  • Shortages.
  • Franchises.
  • Exclusions due to previous illness.
  • Type of employment contract or required professional situation.

What should I check before hiring a disability insurance?

Before you sign up for a policy for disability or incapacity, it’s not enough to just look at the price. Two insurance policies may seem similar and cover very different situations.

See recruitment checklist
  • If it covers illness, accident or both causes.
  • Whether the compensation is daily, monthly or by hourly rate.
  • Amount of the compensation.
  • Maximum duration of the benefit.
  • Initial deficiencies.
  • Franchise or days without coverage.
  • Exclusions for pre-existing conditions.
  • Coverage of relapses.
  • Compatibility with public benefits.
  • Declared profession and actual activities.
  • Age limits.
  • Required medical documentation.
  • Taxation of bonuses and benefits, if applicable.

Which policy is best if I want to secure my debts due to work incapacity?

If your goal is to pay off debts in the event of job loss, you must differentiate between three needs:

  • A temporary drop: It can be covered by workers' compensation insurance, temporary disability insurance, or payment protection insurance.
  • A permanent disability: It can be covered by life insurance with disability, accident insurance, or professional coverage.
  • Death: It is covered with life risk insurance to protect beneficiaries, mortgages, or loans.

In many cases, the appropriate solution is not a single policy, but a combination: unemployment benefits for temporary income, life insurance for death and permanent disability, and payment protection if there are specific premiums you want to secure.

Standard documentation for claiming an insurance benefit for an occupational injury

The exact documentation will depend on the insurer and the policy, but it can usually be requested:

  • DNI or identification document.
  • Policy and receipt in effect.
  • Part medical staff is low.
  • Confirmation parts, if applicable.
  • Part of the medical high-level team.
  • Medical report or diagnosis.
  • Accident documentation, if applicable.
  • Proof of professional activity.
  • Certificate of self-employment or payroll, as applicable.
  • Insurance claim form from the insurer.

It is advisable to report the accident as soon as possible and keep all medical reports related to the leave.

Common mistakes when contracting workers' compensation insurance

  • Believing that life insurance covers any loss: It normally does not cover temporary disability unless there is specific warranty.
  • Not differentiating between temporary and permanent disability: They are different situations and trigger different policies.
  • Contracting for an excessively low compensation: It may not cover fixed expenses, fees, and the actual loss of income.
  • Not checking for deficiencies: Some coverages have not been active since the first day.
  • Forgetting pre-existing diseases: They may be excluded if they already existed before the contract was signed.
  • Not declaring the profession properly: Actual activity can affect acceptance and price.
  • Do not check if it covers common illnesses: Some insurance policies are limited to accidents.
  • Not coordinate it with public provision: The goal is to cover the real gap between expected income and expenses.

Compare your protection against a job loss

A job loss can reduce your income just when your expenses are still the same. Therefore, before hiring, it’s a good idea to calculate what public benefits you would receive, what expenses you would still have to pay, and what financial gap you want to cover.

At PIB Group Iberia, we can help you analyze your situation and compare low-wage insurance, life insurance, accident insurance, health insurance, or payment protection based on your activity, income, family, and debts.
