Compulsory insurance for electric scooters 2026

The Law 5/2025 (24 July) introduced a compulsory insurance liability insurance for Personal Mobility Vehicles (electric scooters, unicycles, etc.). Since the 2 January 2026 These vehicles will need to be insured in order to circulate legally. This means that the home insurance no longer covers damage caused by your scooter or other VMP. The new regulation: compulsory insurance for MPVs

Law 5/2025 amended the Law on Civil Liability and Traffic Insurance. In its first additional provision, it created a compulsory insurance of civil liability for the light personal vehicles (VPL) -i.e. VMPs such as electric scooters- that will be able to register with the DGT. According to the BOE, “the provisions of the first additional provision shall enter into force on 2 January 2026”. In the meantime, the DGT has set up a national register of VMPs.All owners must register their light personal vehicle before taking out insurance.

In practice, from January 2026, the legal text obliges all users of electric scooters that qualify as VPL and other VMPs The minimum liability insurance coverage is 6.45 million euros for personal injury and 1.3 million euros for property damage. These amounts put the scooter on a par with any motor vehicle. Riding without VMP insurance is penalised with fines from €250 to €800 (in addition to the consequent personal and civil risk in the event of an accident).

 

Which vehicles are covered by this obligation?

The reform covers all areas of Personal Mobility Vehicles (PMV) which, by legal definition, are electric skateboards, scooters, unicycles, hoverboards and similar (max. 25 km/h, weight regulated). Newly approved scooters with a VMP certificate are also subject to this. For existing scooters without a number plate, there is a transitional regime (they can use the vehicle until January 2027 after registration). In any case, urban mobility vehicles must have a number plate, a registration certificate and their own insurance from the date indicated.

 

Home insurance vs. specific insurance

Until now, many users believed that the HOME POLICY covered the civil liability of this type of vehicle. With the new law this changes drastically: home insurance ceases to cover damage caused by a scooter or VMP. In other words, home CR is no longer enough. You will need specific urban mobility insurance to comply with the law.

  • Immobilisation of the vehicle: Police or Guardia Civil can withdraw the VMP when it is detected without insurance.
