We are constantly asked by clients and friends if the fact of having a vehicle in their name, even if they have it in a garage immobilized 365 days a year, for whatever reason, means having to take out insurance. The answer is already a YES, but we are going to explain why and on the basis of which regulations this is so.
The law has no doubt
Owning a motor vehicle in Spain makes it compulsory to take out a policy, the only guarantee that is strictly necessary being that of Civil Liability.
This means that the purpose of the legislation is to cover the damages that our car, motorcycle, quad, etc. may cause to third parties.
This is stipulated in Royal Legislative Decree 8/2004, of October 29, 2004, and its “revised text of the Law on civil liability and insurance in the circulation of motor vehicles”.
If it is stationary, what damage can it cause?
Many customers have vehicles that they hardly use.
It does not matter if you drive or not, since the law is clear and will require car insurance. Precisely for this reason, the only guarantee required is the Civil Liability, to cover the damages that our vehicle may cause to others: people, goods, etc.
What are the consequences if I do not have insurance?
These are included in the legislation that regulates these matters, as we have already mentioned, which is Royal Legislative Decree 8/2004:
- The first, the most logical, is that if they detect that we do not have this policy, they would immobilize our car. I don’t think it would matter much to us, if we were not planning to move it…
- The others, do touch our pockets, and they hurt us more:
- We would be fined from 601 to 3,005 euros, depending on the seriousness of the infraction (whether or not you were driving, how long you had been without a policy, etc.).
- The vehicle will also be left in storage until insurance is taken out, and the bill will be paid by the owner.
Trailers and special vehicles under 750 kg do not need a policy, unlike what we are talking about.
Finally, and to specify the only exception to all that we have pointed out: it will not be necessary to make this policy if the vehicle has been deregistered in the Registry of the General Directorate of Traffic. This is the only exemption. To do this, be careful, we must have passed the ITV, so it will be necessary to have insurance to take it to pass the inspection. There is the possibility of contracting an insurance per days for it.
