Since January 1, 2016, all lawyers are obliged to use Lexnet, as a platform for the secure exchange of information between judicial bodies. This seems to be a novelty, however, Lexnet has been used since 2004 by other judicial bodies.
Today, what we are going to explain, in addition to the novelties that this system introduces, is the underlying liability among lawyers as a consequence of sending sensitive information over the Internet.

LEXNET functions
Collects and manages telematically notifications addressed to the lawyer, send writs and demands to the judicial bodies in proceedings in which the lawyer is present.
How to use LEXNET
It is carried out through the electronic signature. Entering the membership card with the electronic signature ACA (Certification Authority of the Bar) in force, the PIN and the card reader.
Its progress is parallel to that of Lexnet in other judicial bodies and instances, both by the Ministry of Justice and by the Autonomous Communities. For this reason, the application to be used by lawyers will be “Lexnet Abogacía”.

What challenges and problems does LEXNET introduce?
Despite the enormous progress made with the introduction of this mechanism to facilitate the exchange of information, there are, of course, new challenges and difficulties.
- The first of these is the learning effort involved among all lawyers, who will have to get used to new ways with which some of them are not at all familiar.
- Mainly, it exposes all the documentation introduced to the Lexnet system to the “piracy“ existing on the Internet. This is something that we had not seen until now, especially when we read the news that talk day after day about the attacks suffered by both governmental and private companies’ web pages, capturing sensitive data for their subsequent commercialization or use.
