As you can see, not all products have the same type of tax advantage. Some reduce taxes when contributing; others can improve taxation by rescuing, provided that specific conditions are met.

What is tax savings?

The tax savings It is the reduction of the tax burden that can be achieved by correctly applying deductions, reductions, exemptions or deferrals provided for by the regulations. In savings products, it can appear in several ways:

  • Reduction in taxable base: It reduces the base upon which the tax is calculated, as is the case with certain social security systems.
  • Exemption of income: Some benefits may not be subject to tax if certain requirements are met, as is the case with certain long-term savings plans.
  • Tax deferral: Taxation is postponed until the time of the rescue or collection.
  • Reduced taxation of income: In life annuities, only a portion of the income can be considered taxable income, depending on age and applicable regulations.

However, a tax advantage does not automatically make a product the best option. It is also necessary to consider liquidity, costs, risk, time horizon, and the method of redemption.

Are savings plans tax-deductible?

It depends on the type of plan. The term “savings plan” is used very broadly, but not all products are tax-deductible.

A pension plan or a Assured Pension Plan Yes, they can reduce the tax base of the IRPF within the legal limits. In contrast, an PIAS or an SIALP does not reduce the tax base due to the contributions made, although they can offer other tax benefits if certain requirements are met.

Therefore:

  • A pension plan can be tax-deductible: Reduce the taxable base within the limits in effect.
  • An APA can deduct: It has tax treatment similar to the pension plan.
  • An IRPF does not deduct contributions when: Their benefit appears if they establish lifetime income by meeting the requirements.
  • An SIALP does not benefit from tax relief by providing: Its advantage lies in the possible exemption from positive yields after 5 years.
  • A paid account or deposit does not itself qualify for a tax deduction: Their interests are taxed as income from movable capital.

Pension plan: the product that can be deducted from income

The pension schemes They are one of the most well-known products when it comes to tax savings. Contributions can reduce the general taxable base of the Personal Income Tax, within the limits established by the regulations.

For the general regime, the Tax Agency sets a limit of 1,500 euros per year, With the possibility of additional increases when rialcompany contributions, employment plans or specific assumptions for self-employed workers and other social security systems are involved.

You can check the official table of the Tax Agency here reductions in the general taxable base due to contributions to social security schemes.

The tax advantage of pension plans should be interpreted with caution: less may be paid in the contribution year, but the benefits are taxed when they are withdrawn. Therefore, it is not enough to look at the initial tax savings; the timing and method of payment must also be planned.

PPA: Plan of Assured Pension

The PPA The Plan de Previsión Asegurado is a life insurance product aimed at retirement. It shares tax treatment with other social security schemes, so it can reduce the taxable base within the limits in force.

It could be interesting for conservative profiles looking for a retirement insurance solution, usually with guaranteed interest terms in the terms of the policy.

Before hiring a PPA, it is advisable to check:

  • Guaranteed profitability.
  • Contribution limits and tax reductions.
  • Liquidity and rescue assumptions.
  • Taxation when receiving the benefit.
  • Costs and conditions of mobilization.
  • Solvency of the insurance company.

The PPA can reduce the current tax bill, but it should not be contracted if immediate availability of the money is needed.

PIAS: tax advantage if paid as lifetime income

The PIAS, The , or Individual Systematic Savings Plan, is an individual life insurance designed to provide a guaranteed lifetime income with the contributions made.

The contribution to an PIAS No tax deduction in the income tax return. Its tax advantage appears if the product is transformed into lifetime income and the requirements set by the regulations are met.

According to the Tax Agency, PIAS must be instrumented through individual life insurance policies in which the policyholder, insured person, and beneficiary are the same person. Additionally, the first premium must be paid more than five years prior to the creation of the life annuity. The maximum annual premium limit is 8,000 euros and the accumulated total cannot exceed 240,000 euros per contributor.

You can consult the official information about Individual Systematic Savings Plans at the Tax Agency.

A PRIAS may be suitable if you want to save regularly and plan for future income, but it should not be chosen solely on the basis of its taxation. Costs, profitability, liquidity and rescue conditions are also important factors.

SIALP and CIALP: long-term savings plans

The Long-term Savings Plans They can be instrumented as a Long-Term Individual Savings Insurance, known as SIALP, or as a Long-Term Individual Savings Account, known as CIALP.

These products They do not get a tax deduction by contributing. Its tax advantage consists in the fact that positive returns on movable capital may be exempt if the legal requirements are met, including the requirement that the capital is not available before five years have passed since the plan was opened.

Among the main requirements are:

  • Only one Long-Term Savings Plan can be held at the same time.
  • The contributions cannot exceed 5,000 euros per year.
  • No partial arrangements are allowed.
  • The plan must be maintained for at least 5 years to maintain the exemption.
  • The entity must guarantee at least the 85% of the contributions at the expiration date.

You can check the official requirements from Long-Term Savings Plans at the Tax Agency.

The SIALP may be interesting for conservative savers who can hold the product for the legal term and do not need partial liquidity.

Guaranteed lifetime income and tax benefits for people over 65

The Tax Agency states that the capital gains derived from the transfer of assets by taxpayers over 65 years of age may be exempt if the total amount obtained is used to establish a life annuity guaranteed to them. The life annuity must be established within the time limit 6 months and the maximum total amount that can be allocated for this purpose is 240,000 euros.

You can consult the official requirements here Exemption for reinvestment in life annuities.

This product should not be interpreted as a universal solution. Its interest depends on age, wealth, need for regular income, beneficiaries, liquidity, taxation, and succession planning.

Products that do not provide tax relief even though they generate savings

Many financial products can be useful for saving or investing, but that doesn't mean they are tax-deductible on your income.

Product Tax relief? How to normally file taxes
Paid account Not by rule. Interest is taxed as income from movable capital.
Bank deposit Not by rule. Interest is taxed as income from movable capital.
Investment funds They do not provide a tax deduction for contributions. They can allow tax deferral in transfers between funds, but they do not reduce the taxable base by contributing.
Unit linked No tax deduction for contributions. The taxation depends on the structure of the insurance, the coverage, the beneficiaries, and the terms of the policy.
Traditional savings insurance Not necessarily. It depends on whether it is PIAS, SIALP, rent, guaranteed insurance or another modality.

Do tax-advantaged accounts exist?

In Spain, it should not be assumed that a bank account has tax advantages simply because it is called a savings account. Remunerated accounts, current accounts, or deposits do not themselves qualify for tax relief under the IRPF.

There are specific assumptions linked to deductions or transitional regimes, such as certain amounts related to investment in habitual housing when certain requirements are met. The Tax Agency sets a maximum base of 9,040 euros per year for taxpayers entitled to this deduction for amounts invested in the acquisition, renovation, construction or expansion of habitual housing.

You can check the official information about deduction for investment in a habitual residence.

In any case, it is not advisable to confuse a bank account with a product that is fiscally advantageous. The fiscal advantage must be expressly provided for by the regulations and all requirements must be met.

Which product should you choose based on your goal?

Objective Product that can fit What to check
Reduce the tax base in the IRPF Pension plan or PPA. Annual limits, liquidity, tax treatment for rescue and retirement horizon.
Saving regularly for future income PIAS. 5-year term, contribution limits, lifetime income, and costs.

Taxation of savings insurance

The taxation of savings insurance depends greatly on the type of product. A guaranteed insurance, an PIAS, an SIALP, a life annuity or a unit linked product do not all tax in the same way.

Before hiring, check:

  • If the contribution reduces the taxable base: Not all products allow it.
  • If there is a conditional exemption: Some products only have a tax advantage if they are kept for a specific period of time.
  • How the bailout is taxed: It can be taxed as income from movable capital or as income from labor, depending on the product.
  • If there are penalties for early redemption: Leaving earlier can reduce profitability or lead to lost tax benefits.
  • If it is charged in capital or rent: The method of payment can change taxation.
  • If there are beneficiaries: In life insurance, succession taxation can intervene in certain cases.

What happens if I misapply a tax advantage?

Incorrectly applying a reduction, exemption, or tax benefit may lead to subsequent regularization. Depending on the case, the Administration may require the payment of any outstanding fees, interest, surcharges, or penalties.

The General Tax Law regulates the penalties for late filing of tax returns and the infractions for failing to pay the tax debt due within the deadline that would result from a correct self-assessment.

You can check the Law 58/2003, General Tributary.

Therefore, before you contract a product based on its taxation aspects, it is advisable to confirm that you meet the requirements and that the benefit actually fits your situation.

Common mistakes when seeking tax savings

  • Thinking that all savings plans are tax-deductible: Only some products allow the reduction of the taxable base.
  • Confusing relief and exemption: One reduces taxes by contributing; the other can avoid taxation of certain income if certain requirements are met.
  • Do not review annual limits: Exceeding limits can lead to losing advantages or preventing the application of reductions.
  • Not valuing liquidity: Some products are interesting fiscally, but they don't fit if you need the money soon.
  • Choosing only for taxes: Profitability, costs, risk and time frame also matter.
  • Not planning the rescue: The initial tax savings may lose their appeal if the subsequent collection is not planned properly.
  • Applying outdated regulations: Tax limits have changed in recent years and must be reviewed each fiscal year.
  • Not differentiating between common territory and fiefdoms: Basque Country and Navarre may have their own rules.

How to choose a savings product with tax benefits?

To choose wisely, it is advisable to start with the objective, not with the tax advantage. The best product will not be the same for someone who wants to save for retirement, for someone who seeks liquidity, for someone who wants to convert their wealth into income, or for someone who wants to optimize the taxation of a capital gain.

Before hiring, answer these questions:

  • Am I looking to reduce taxes now or plan for a future tax advantage?
  • Do I need short-term liquidity?
  • Am I willing to keep the product for 5 years or more?
  • Do I want guaranteed capital?
  • Do I accept market risk?
  • What costs does the product have?
  • How will the bailout be taxed?
  • Do I have the beneficiary clearly in mind?
  • Am I within the legal limits for contribution?
