Is there such a thing as graphic designer insurance? We analyze why they are contracted

A graphic designer must convey a series of messages requested by his client. His or her work must conform to those requests, and be able to achieve the objective demanded of him or her. Graphic designer insurance is there to protect you.

By charging a fee for this work, a professional liability is assumed and, as such, we will see why there are specific insurances in the market for this profession.

The importance of “segmented” insurance

Increasingly, in the insurance world, there is a demand for policies that are tailored to the specific needs of each profession. We call them “segments”, and this is one of them.

The marketing sector, like the technology sector, has been booming for many years and there is no turning back. In the same way that claims derived from work carried out by professionals, which the client considers inadequate, continue to grow.

Each profession carries specific risks: liability insurance for an electrician is not the same as for a graphic designer. For this reason, there are some insurance companies that specialize and focus on growing segments. The consequence? They adapt the insurance terms and conditions (the rules governing coverages and exclusions) to protect these professionals.

Most policies on the market have generic liability coverage:

  • Exploitation: you go to the customer’s workplace and break a monitor by a blow.
  • Locative: when renting an office, you may cause damage to a glass pane, which must be paid to the landlord.

In this previous post, we talked about the most common liability insurance guarantees.

Today we want to highlight the importance of professional liability, derived purely from our professional activity, for which we have been trained.

The basic guarantee of these policies is intended to cover “pure pecuniary damages”, which are basically economic losses suffered by a client, and which are neither personal nor purely material damages.

Possible claims in the insurance of graphic designers

These would be a series of examples that will not find coverage in traditional CR policies, but specific to graphic designers:

  1. Making an advertisement for a client we introduced a soundtrack that violates intellectual property rights, or a photo taken from the Internet, but had image rights→ claim for 10,000 euros.
  2. To create a video in a corporate presentation, the client provides us with some very sensitive (confidential) internal data on which to base it. When the folder needs to be returned, we can’t find it. In the wrong hands it can be a breach of confidentiality and may lead to a claim.
  3. We design a job for a client. When we deliver the final product, the client claims that it does not match what was agreed and claims damages for the delay that this means when they were waiting for it to launch a campaign.
  4. Similar to the previous one, for a delay: due to an accident and having two projects to present in a deadline, the clients claim me an economic amount for not complying with the stipulated delivery time.

In addition to the possible indemnity that we will have to pay, in order to be able to refute and argue our defense, we will need a lawyer. The insurance also covers a specialized legal defense in this type of claims.
