Thanks to the Law 35/2015 “reform of the system for the valuation of damages caused to persons in traffic accidents”.” or, better known as “the law of the scale”.”, the day 1 January 2016 new tables were introduced setting out the compensation to be paid to victims of road accidents on our roads.
What's new in the reform of the Baremo
In this way, the legislation that has existed since 1995 is modified. Moreover, it did not contemplate certain cases that occur in our society, such as: compensation for single-parent families or for children born out of wedlock, for example.
How do they vary?
- death benefits are to be increased by 50% on average,
- sequel compensation will rise by approximately 35%, and
- injury claims will increase by 12.81 p.p.t.3T.
Despite this, the means of proof are tightened and the requirements for minor injuries are increased, which could lead to a reduction in payments in these claims, which are the most frequent. Therefore, this reform, which comes into force on 1 January 2016, is not without controversy.

Consequences of this amendment on car insurance
This increase in compensation payments is borne by the insurance companies. For this reason, increase the premiums charged for their car insurance.
The insurers intend to share this additional cost between themselves and the policyholders. It is therefore expected that insurance renewals will increase across the board.
Victims' Associations Reaction
The victims' associations have already reacted to this change announced as early as September this year in a very optimistic manner. They were present, through their representatives, in the commission that studied the introduction of this regulatory change.
This result is the result of 4 years of work between 2011 and 2014. In the same way as the Bar Associations are happy with the change, understanding that certain injustices were taking place, which could be solved by introducing these modifications. Again, we warn of the problems they may cause in minor injuries; but it is true that serious accidents are improved for victims.
